Archard v. Goonan. —Claim £3 19s. 6d., for goods and accommodation. Defendant pleaded payment of account. Judgment for plaintiff., with costs. ' ■ Arohard v. Healey, for lodging. Judgment by default. Read's Trustees v. Mulloolly. Mr. Ward applied for the case to be struck out as an arrangement for settlement had been arrived at. ;
Assault and Riot.
P. Bond v. MatiniKaipau and others. — Mr. Rogan and Mr. Brassey for the prosecution, and Mr. Nolan for the defendants. Mr. E. Woon? aoted as interpreter, and took the depositions. The oharge for riot was first proceeded with. • •- - Mr. Nolan said that before going into the case, he would like to know whether he (Captain Gudgeon) was -sitting as a R.M. or J.P, The Bench : I am sitting ast&.M. 1 1 am Resident Magistrate for the Wairoa and Waiapu districts. Mr. Nolan : That was why he could not sit. The 16th clause of the &M. Act precluded him from sitting m the Court. . '."','■». The Benoh i He would sit as a J.P. Mr. Nolan : In that oase he would apply for an adjournment, as a J.P. could not make a warrant for their odmmittal. He would prefer Mr. Rees, who was oounsel for the Natives. Mr. Rogan objeoted most strongly to any adjournment. Mi\ P. Bond was put into the box, and sworn, when Mr. Nolan contended that the depositions should be taken m Maori and English concurrently. The Benoh thought it was not a point of any importance but would concede it to defendants counsel m order that the Natives would be led to the belief that they received fair play m the Coui'ts. He would employ Mr. .Ferris to take down the statement m Maqri, and translate it also. Mr. Ferris was then formally sworn as interpreter, P. Bond, deposed ? I reside at Matawhero. I know a block of land called Matawhero No. 1, a portion of which I leased on the 16th Maroh last, from the trustees of the late G, E, Read, I took possession of the land m oonjunotlon with Mr. John Allan, my partner. We placed about 1,800 sheep on it. We remained m quiet possession of the land up to the 16th of July. There was some interference with the ground Vrevioua to thin.
