WAVERLEY TOWN BOARD

Special Meeting. A special meeting of the Town Board was held in the Boards meeting room on Thursday evening, Mr B P Palmer presiding. Messrs S J Price, J L Linklater, 1 Bason and Mr Climie engineer were also present. The Chairman asked Mr Olimie to give the Board some further particulars with regard to his offer to the Board to cornplate the water and drainage schemes Mr Olimie stated that at present he did not know what contracts were finished and what were not. He would take a lump sum to complete the work or carry it out on a percentage basis. The Chairman: If we give you the work what time would yon devote to it ? Mr Olimie; I would draw out all the plans and start the work at once and put a qualified man in charge of the work. The Chairman explained that the Wanganui Borough Council had been asked to allow their engineer to come to Waverley and report all the works. It was then resolved that Messrs Climie and Bon be appointed engineers to the Board as per Mr Climie’s offer and that an agreement be drawn up between them and the Board to this effect. It was also resolved that the Board’s solicitor be instructed to have all papers ready by Wednesday 22ad iust, when Mr Climie would be visiting Waverley. It was further resolved that Mr Climie see Mr Htavely, engineer to the Wanganui Borough Council, and arrange a time with him to visit Waverley and confer as to - the best means of repairing the damaged wall. The Board then adjourned, MAGISTRATE’S COURT. A sitting of the Magistrate’s Court was held at the Wavetley Court House on Thursday morning before W Kerr Esq S.M* Benson v Q Piroa, claim £l2 16s 3d. Judgment given for amount claimed and costs £2 3s 6d. Benson v Tui, claim £9 6s sd. judgment for amount and cists £1 IGs 6d. Benson v Taipaki, claim £l4 13s 61. Judgment for amount, and costs £2 8s 6d. J and J Bradley v Clark B os , claim £6l los. Judgment for amount and costs £4 7s 6d. P J Benson v Mrs M Teka, claim £3 sa, Judgment for amount, and costs £1 9s. P J Benson v M Teka, claim £1 4s 4d. Judgment for amount, and costs £1 4s. Hurley v Hcrepu, claim £22 ss. Judgment for amount, and costs £3 ss. Benson v Jacob. Mr. Macdonald appeared for the defendant and explained that the man did not understind that they bad to give notice to defend the case. Judgment was given for the amount claimed, execution to be suspended till August 20th to give defendant an opportunity of bringing a cross action. Kavanagb v Montifiore, claim £ll os. Mr Graham appeared for plaintiff, and Mr C H Taylor, of Welsh and McCarthy, Hawera, for defendant. Mrs Kavanagh sworn said she had two men named Campbell and Penn boarding with her. Mr Crowley represented himself as being foreman for Mr Montifiore and asked if she cculd give him the use of a paddock for eighteen horses and a loose box for storing feed. She agreed to take the horses for ton shillings per week. They used them for four weeks and five days. Crowley told her he was working for Monfefiore. She had not room for five men and took three as the manager was responsible for their board, She sent the aoccunt to Mr Montefiore but it had not been paid. It was a reasonable charge, Cross examined by Mr Taylor witness stated that in the course of conversation with Crowley belaid that Mr Montefiore was good and would pay the accounts: Witness did not expect Crowley and Penn to pay. Witness expected Mr Montefiore fo pay her. The third man was Smith. Witness bad been paid for his board but could not say who paid the money. It was paid the day the man left the house* Witness never asked them for their board ns she expected Mr Montefiore to pay, Witness ,did not see him about the matter as she accepted the statement made by Crowley to be correct. There was about half an acre of land where the horses were fed. The stables were-used for storing the feed. They had a lock of their own and kept it locked. The horses were not kept there at night. In reply to Mr Graham witness stated that Mr Montefiore bad paid Mr Smith, hotelkeeper the board for the men at Patea. Mr Montefiore had used witness’ telephone to tell Smith he would pay the men’s board at Patea: By the Bench; Mr Crowley asked how mnch witness would charge for the use of a loose box and ten shillings was arranged. The men left before seven in the morning with their t’arna. Witness had not seen them since. Had no conversation with defendant about the board. Witness trok Crowley’s woid for the arrangement. James Penn sworn sa : d he was working for Mr Montefiore and he stayed with Mrs Kavanagh ; made no arrangement for his board. Mr Crowley sent him to the hotel and the board was stopped out of his wages. Witness was paid in Patea. Mr Crowley and Mr (Montefiore were both there. Witness wanted his wages in full so that be could pay his board bub Mr Crowley said he was going to Waverley to pay the paddock rent and would pay bis board. This had since be e n paid by Montefiore at Hawera.

Cross examined by Mr Taylor; Witness made no arrangement with Mrs Kavanagb about board. Witness had beard about Montefiore and wanted to pay bis own board. Witness did not speak to Mrs Kavanagb about the board because they were told by Mr Crowley to go there and that everything was fixed up for them. Witness was not off work at Waverley any days through being drunk, He did not get into trouble with Mr Crowley. He was quite sober when the conversnt'ou about the wages took place. Mr Montefiore sworn said he was a contractor and earned on contract work at Waverley where he had ten men. Ha did not give authority to any person to say he would pay their board, Crowley was a man he gaye Is per day more than the others as head carter who kept the men’s time and was in witness’ employ until last week, He gave him no authority on financial matters. On three occasions witness had paid bis mcu’s board. This wss at Stratford. Kaponga and Patea. He always made the arrangement with the men himself. Mr Graham : You gave Mr Crowley a certain amount of authority '? Witness. No financial authority. His Worship in summing up said that he would give a nonsuit on the account for men’s board and would give judgment for plaintiff for £2 5a for the balance with costa.
