ALLEGED MISREPRESENTATION NAPIER, June 16. The Supreme Court was occupied all day and until 10.10 to-night, in hearing a civil case in which the Coromandel Granite Company claimed £706 from John William Fitiillay, public accountant. The sum claimed was advanced as a result of alleged misrepresentation of the state of the company’s accounts by defendant when he was secretary. The defendant showed a profit on the whole of the company’s workings at Napier, Auckland, and Wanganui of £213 7s Id. There was, according to his statement, a profit of £2OOO in the Napier and Hastings workings, in view of which tho directors advanced bonuses to the works manager at Napier and the defendant. A refund of these was claimed, also a return of tho defendant’s salary. The plaintiff company also alleged that F indlay had failed to keep proper books, and charged him with negligence. The auditor who examined the accounts put the company’s loss at £5343 15s 3d. Mr A. Gray, K.G., and Mr J. Mason appeared for plaintiffs, and Mr M. Myers and Mr M. B. Grant for the defendant. The case for the defence lias not yet been presented. June 17. The case in which the Coromandel Granite Company claimed £706 from J. W. Findlay occupied ihe attention of tho Supi fe&iSW Court ivi-firi to-day, and until 10.20 to-nlglit, when the hearing of evidence was concluded. Legal argument was adjourned to Wellington. The defence contended that, the general manager was in Auckland, and that Iho defendant thought tho accounts were kept there.
