On May 16 an action was commenced wheroin Peter Varawa- claimed £20,000 damages from the Howard Smith Company for alleged breach of contract and false iniprisonmsnt. The action arose out of negotiations in 1904 during the Russo-Japanese war for the sale of the steamer Feregrine. According to the affidavits, Varawa was acting through a shipbrofcer named Moller. He arranged to purchase the Peregrine, but thp Commonwealth Government, becoming aware of the negotiations for the alleged sale of the vessel to Russia, intervened, and declined to allow the sale or delivery as cortrary to the laws of neutrality Failing to receive the delivery of the Peregrine, Varawa came to Australia and interviewed Howalrd Smith's manager. Subsequently on an affidavit -.worn _by Moller an affidavit was sworn against Varawa, and he was imprisoned for 11 days.
