The roadway between the rails had been .allowed to fall into disrepair, being sin below the level, while tbe entire street s=ave " 14ft" was blocked by trucks. This le.it no -choice to a driver, and with the dip made in "the road and the wheels striking the _ further rail, the horse caiuei down. Hazlemore was thrown and badly hurt. Mr M'Carthy gave judgment for £59. Messrs Wright, Stephensori. and Co. and tbe corporation appealed on the facis and law. Mr Justice Cooper findi for HazVmors at evenry point and awards him £10 co^ts against each of the appellant* •
