ARBITRATION COURT

(Feom Oue Own Correspondent.) CROMYTELL. September 19.

The members of the Arbitration Court arrived this morning from Clyde, and the court opened at 10.30 a.m. The case of JNlrs Eoeking against the Rising Sun Company, a claim for compensation was taken; Mr Brodrick for plaintiff and Messrs Sim and Hutfcon for defendant. Evidence was given for plaintiff by Clements (blacksmith), who was alongside of Hosking when killed and when the belt was fouled. He said he asked Hosking- to stop the engine. The only point raised was whether the injury arc-so out of dt in the course of employment. The following dredg-emasters gave evidence : —6. M'Lay, W. Kane, A. Hedley, N. Kloog-h, and Alox. Boss; also R. Jack and J. Jones, engineers, and TV. Kenshaw, winohman on the dredge that day. All the witnesses agreed that Hosking should not have tried to clear the belt, and should have stopped the engines. The bolt fouled the screen shaft. It was used for working the boring machine. After the belt was thrown, off it fouled on the shaft, when Hosking, as fireman, came to clear it, and lost his life. The witnesses all agreed that a fireman had a right to be there. Mr Sim, for the defence, contended that ho had 110 right chore at all, especially not to try and clear the bolt after being asked by the blacksmith to stop the engine. Great local interest is taken in the case, and the court was crowded ail ; day. '
