THE APPEAL COURT.
Wellington, May 25.
To-day, in the Appeal Courf, judgment ia the case of Ellis v, Ba.tger and another was delivered by Mr Justice Dennisbon. The court; • found that the New Zealand Loan and Mercantile Agency Company had intended to receive the sums in question as agents for the collec* tion of rents for Messrs Kenyou and Hoaking, and that the payment was made in such a way as to amount to payment to the principals. The court held, further, that the creditfng o£ Messrs Kenyon and Hosking in the books o£ the company amounted to payment. Looking to the 'relations between them and the company on the facts found, the court were of opinion that the subsequent reversal of the entries did not affect the matter. The appeal was allowed with costs on the lowest scale, as from a distance.

HfiadeJine Cross, who was arrested yesterday J ©n & charge of murder, wag a domestic eeivant, Aged 18. The body of the infant was found on .• Wednesday night, quite dead, with its throat #ut open with a pair of scissors. The accused ' ■was ccr fined on Sunday, during the absence of Jtter emi'icyers, who were from horns all day. jShe di>p3fed of the aftnr-iraces, but was too ill to take the body away. The accused came jbere frcni Wellington less than six months ago, s,nd her condition was not suspected.

At the inquest at Oarlerfcon on the body of the newiy-born iufanfc of Madeline Cross the -evidence showed that their were three wounds £0 the throat, made with sciaeor<». At tie request of civil servants the Premier lias consented -to erect a. special building in jwhicb the bicycles of- those who work in "the largest wooden building in the world " «an be stored. There will be space for 50 machines.
Mrs Walter Stott, who returned to New Zealand in the Gothic, after an absence of 12 months, was .given "A Welcome Home" in the Volunteer Hall, Green Island, on Friday evening, 20bh insr., by a large nnmber of friends. Daring the evemeg Mrs Stott wa? presented with a handsome gold tangle by the Mayor of the borough (Mr James Miller) on behalf of her wellwithers. Hr Will responded on "behalf of pile recipient. Dancing was indulged in during fche evening, which passed off in an enjoyable manner.
