In Chamber* on Friday moraing Mr Hosking made application to his Honor Mr Justice Williams for the appointment of Mr William Richard Cook as sole official liquidator of Walter Guthrie and Company (Limited). His Honor said : There are a lot of affidavits filed in reßpect of this motion in answer to affidavits which are not filed. Mr Hosking : I understand there ia to be no objection to our motion that Mr Cook should bo the sole official liquidator. It was known that affidavits had been prepared in opposition to Mr Cook's appointment, but the debenture-holders who wero opposing the appointment have decided to abandon their opposition. The only thing 13 that certain matters camo before the official liquidator and before the solicitors having the carriage of the proceedings, and they have thought it desirable that, at all events, your Honor should have an opportunity of seeing them. If youi Honor sees fit to mike the appointment the other side consent. Mr Sim : We do not oppose. Mr Hoiking : Having the carriage of the pro CPedings it was from a sense of duty that wa brought the matter forward, so that if there is any question as to fitness or otherwise your Honor should have an opporhmity of judging. It does not affect the bank. They still, by the fact of my application, concur in the appointment of Mi Cook. His Honor : If the other side do not file affidavits to raise objections to the appointment of Mi Cook, and as the bank and Mr Sim's clients art the only persons interested, and they do not object, I suppose there is no doubt about it. Mr Hosking : I considered it necessary to file the answers. His Honor : There is no reason why you should not file them. Order made appointing Mr Cook official liqur dator. By operation of the wind-ing-up order all servants were dismissed, but they wanted power effectually te dismiss two 01 three, and did not want to be hampered by tha restrictive clause under which the provisional liquidator had been appointed. He would like it to be clear that the restrictions previously existing did not continue. His Honor : Very well ; the liquidator will have all the power given under section 158, without the sanction of the court.
