Legislative Council Appointments. TO THE EDITOR.
Sir, — In the discussion that may arise as to the Governor's action in declining the advice of the Ministry regarding calls to the Council, ib may be of interest to note what is said in the most recent work on the Constitution. The second volume on the Law and Custom of the Constitution by Sir W. R. Anson has just been published. The preface is dated January 1892. Professor Anson says (p. 261) :—: —
The Governor of a self-governing colony ia a Constitutional King : his discretion must be that of his responsible Advisers ; ht may endeavour to influence them, but he must not act coutrary to their final decision, unless he is prepared to appeal from them to the colonial Parliament, and ultimately to the colonial electorate.
As to Professor Anson's authority to so write, Professor A. V. Dicey says : —
Sir William Anson's " Law and Custom of tho Constitution " is the most valuable treatise which has appeared for years on the English Constitution as it actually exists.
If the Governor had acted constitutionally tho new Legislative Councillors would ere this have been appointed. — I am, &c.,
