At this stage the .Magistrate intimated that he did not see how Lupes could sustain a claim for grazing on the canal reserve, seeing that Lupes himself had no right to graze animals there except those used in connection with the works. If he could prove that other animals came on the reserve and deprived Lupes' horses of feed he might have a claim for damages, but otherwise he would have no claim at all. Mr Porntf said he would take a nonsuit on the counter-claim, and later on bring an action for damages. Regarding the claim by Handley, the Magistrate said that the circumstances supported Handley's version, and judgment would be for plaintiff for £7 16s and costs £2 14s o.d. Defendant Lupes was also ordered to pay £2 10s costs on the counter-claim.
