SALE OF CAR
JUDGMENT FOR PLAINTIFF
Judgment for the plaintiff was given by Mr H. W. Bundle, S.M., in the Magistrate’s Court yesterday in his reserved decision on a claim by John Reid Wilson, of Tawanui (Mr W. S. Armitage) against T. E. G. Mark, of Christchurch (Mr G. M. Lloyd) for the sum of £SO, allegedly owing on a second-hand De Soto car sold by the plaintiff to the defendant on November 17, 1946. The magistrate, after reviewing the evidence, said that the defendant paid the plaintiff £550 for the car. There was an agreement between the defendant and the plaintiff that the price would be £6OO if the defendant was unable to obtain for the plaintiff another car. to the value of about £IOO. No such car was obtained by the defendant, and judgment would therefore be given for the plaintiff for £SO, with costs (£8 10s 6d). Undefended Cases Judgment for the plaintiff was given in the following undefended cases:— Graham Coal Company, Ltd., v. J. McKechnie, £1 10s 6d, for goods supplied, with costs (10s); Graham Coal Company, Ltd., v. J. Wills, £8 15s, for goods supplied, with costs (£1 5s 6d); Neill and Co., Ltd., v. E. McNult (Tahakopa), £4 8s Bd, for goods supplied, with costs (£1 5s 6d).
