DESERTION CHARGE
GUNNER COURT MARTIALLED CALL OF DOMESTIC OBLIGATION (P.A.) AUCKLAND. Sept. 16, A plea of not guilty was entered by Gunner Joseph Murray, aged 27. when he was charged at a court martial at Devonport this morning with deserting from his Majesty’s forces in that on May 18 last he absented himself from his unit until he was apprehended by the civil police on August 29, when he was wearing civilian clothes. For the accused, it was stated that lie volunteered for overseas service at the beginning of the war. but was put in class 2. He married after May 1. 1940, and was called up as a single man and posted to the 62nd Battery. After serving for three days he was admitted to hospital, and while there he learned that his wife was expecting a child. On discharge from the hospital, he chose his duties as a husband in preference to those of a soldier. He said he did not desert, but was merely absent without leave After his punishment he desired to straighten out his family affairs and then return to his duties. ’* The finding of the court will be promulgated.
