HUNTER WILL CASE
A NOVEL DEVELOPMENT LADY HUNTER TO ARGUE APPEAL ■ —— f (Per United Press association.) WELLINGTON, June 19. Another phase of the now famous Hunter family litigation is to come before the Court of Appeal on June 28. When the case was called by the registrar of the Court of Appeal this morning for the purpose of appointing a fixture for the hearing, Lady Hunter, who was sitting in the back of the court, rose, and, coming forward, said she would be arguing the appeal herself in person, and, at her request, the fixture was made for June 28. It is understood that the proceedings involve an appeal from an order of Mr Justice Blair made in November last, when he dismissed an application brought by Lady Hunter for variation in her favour of a previous order made by the same judge in June, 1932, under the Family Protection Act, granting Lady Hunter an allowance of £4OO per annum out of capital. Whilst the appearance of a woman litigant to argue her own suit in any court is most unusual. Lady Hunter’s intended action will be still more rare. Inquiries made from the court officials elicited that to the best of their knowledge this will be the first time in New Zealand that a woman litigant has appeared before the Court of Appeal. At the same time it is recollected that recently a Canadian woman' litigant appeared before the Privy Council and prosecuted successfully her appeal from the Canadian courts.
