LEGALITY QUESTIONED TEST CASE BEFORE COURT. (Peb United Press Association.!. WELLINGTON, April 28. A test case to decide whether Sunday night concerts in cabarets and restaurants are legal or not is being heard in the Magistrate’s Court to-day. The police submitted that the premises were being opened for a double purpose. As refreshment rooms they were not entitled to be opened on Sundays for the purpose of a concert. The defence contended that the premises were licensed eating houses, and a license had been granted by the council for programmes. No reference had boon made in advertisements to auy charge for concerts. After formal evidence had been called to show that the premises were licensed as an eating house and that a license had been granted by the City Council for programmes, the magistrate reserved his decision.
