(From Our Own Correspondent.) BALCLUTHA, July 11. CLAIM FOR DAMAGES. Mr H. J. Dixon, S.M., delivered his reserved judgment this morning In the case A. L. Shepard v. the National !Mortgage and Agency Company, a claim of £35 3s for damages to the plaintiff’s car as the result of a collision with a car driven by Stanley Eiach, an agent for defendants. Negligence on the part of the latter was alleged. The defendants counter-claimed for £ls 9s 9d, damages to their car, and alleged that the collision was due to the negligence of the plaintiff.—The magistrate said that in his opinion the defendants’ agent had been negligent, and such negligence was the cause of the accident. He could not find any evidence of contributory negligence on the part of the plaintiff. The amount of damages claimed was disputed. A witness gave evidence for the

defence that the repairs could have been done more cheaply, but his evidence did not justify that conclusion. The amount actually paid would be allowed for repairs, with the exception of towage, and 15s would be allowed for that. Judgment would be for the plaintiff for £34 8s on the claim, with £2 5s court costs, solicitor’s fee £4 3s, and witnesses’ expenses. Judgment would be for the defendant (Shepard) in the counter-claim, with costs (£2 2s). MORTGAGE ADJUSTMENT. The Mortgage Adjustment Committee for Otago, consisting of Messrs F. Waite (chairman), E. H. Murney, and C. E. Sheat, commenced a sitting at Balclutha Courthouse this afternoon, and will sit again to-morrow and on Wednesday. NEW APPOINTMENT, Out of 18 applicants the South Otago High School Board of Governors on Friday night selected Mr A. Nash (Waimate) to fill the position of extra assistant rendered possible by the increase in attendance. Mr Nash holds a D certificate, and is a graduate from Lincoln College as bachelor of agriculture. At the same meeting the resignation of Mr P. A. Watt (Warepa) as a member of the board on account of illness was received with regret.
