ALLOWANCE UNDER WILL.
WIDOW SEEKS AN INCREASE. LARGE BEQUESTS TO CHARITY. (Peb United Press Association.) WELLINGTON, November- 28. Application was made in the Supreme Court to-day, before Mr Justice Ostler, for ,an increase in the allowance made under her husband’s will to Mary Mackin, widow of Dr Patrick Mackin, of Wellington. The ground on which the application was made was that the provision for the plaintiff’s maintenance was inadequate, having regard to the value of the estate and other circumstances. The value of the estate after payment of death and succession duties and other outgoings was about £34,000, a fund of £17,0p0 being set aside' to' provide an annuity for the plaintiff’s maintenance during her lifetime. After this £12,000 would go to various charities, leaving £SOOO to fall into the residue. According , to the affidavit filed by the Public Trustee," the executor' of the estate, the legacies given under the will totalled £16,000, the greater part of which was absorbed by charities. The testator left his residuary estate to the Bishop of Down and Connor, Ireland, and other substantial benefits to the parish priest of Kilkeel, -Ireland. His widow received £IOOO and furniture valued at £278, in addition to the interest on £17,000, giving her about £B4O a year. . j Mr P. B, Cooke, for the Public Trustee, maintained that the provision was ample. His Honor reserved his decision.
