Burgess was sentenced to a year’s imprisonment. The sentence was suspended under the First Offenders Act, the judge remarking that he accepted the contention of accused’s counsel that Burgess was influenced to some extent by pernicious picture shows, at which lawlessless was presented as something to be admired, and where men who used revolvers and knives were held up as heroes. The judge said there were circumstances connected with picture shows which were having an evil influence on the youth of the country.
David Allen Burgess was found guilty of manslaughter in connection with the death of James Riddell, who was fatally shot in the street at Annandale as the out come of gang quarrels.
