ALLEGED ADULTERATION OF MILK.

AN APPEAL UPHELD.

(Per United Press Association.) AUCKLAND, August' 16. Before Mr Justice Denniston an appeal was made by Samuel Wood, a milkman, against the decision of the magistrate in Convicting him on a charge of mixing extraneous ingredients wilh milk—to wit, borio acid. Evidence was given, and his Honor said there was no doubt the offencc had been committed, but the question was as to whether it was Iho appellant who did it. Before a man could he guilty of the offence of "mixing" ho must "mix," and it was for the Crown to prove it. No proof, however, had been given. Tho appeal was allowed. His Honor said that if tho effect of his decision was to render the-section, useless, then perhaps the Legislature might legislate further on the matter.
