Fiuday, July 18. (Before Meijsrs J. Ashcroft andA. Barr, J.P's.

Larokny.—Geo. M'Kenzie and Win. Solomon were charged, on remand, with stealing a watch, valued at £3, tho property of Jas. Mahon, at Dunedin, oa or about tho 26th March 1890.—Mr Hanlon appeared for the accused M'Kenzie, and Mr Solomon for the other accused.—ln this ease, which had been remanded for a week, the evidence of several witnesses had been taken. This evidence was read to the court.—Eobert Jenkins, labourer, at Morven Hills station, gave evidence, and said that he was In Dunedin in April last. He bought the watch produced off M'Kenzie on about the 7th April. He met Solomon, whom he had known for the last six yearn, at tho Octagon, and mentioned to him that ho; wanted to buy a watch. Solomon told witness that he knew whore he |could get a cheap watch, which was also a good watch. The owner wanted to sell it, bb he was hard up. He met Solomon and M'Kenzia as arranged at the Octagon that same afternoon. Ha and .both accused were resting on the grass, ana after looking at the watch he agreed to give £2103 for it. He took out 30s and laid it on, the grass. Solomon, who was next witness," handed the money to M'Kenzie, and said that he should get the balance. M'Kenzie agreed to that, so witness [gave Solomon £1. Solomon said that it the watch did sot give satisfaction he would buy it 'at the same price. A day or two after buying the watch witness got his name and the date engraved on the watch at the exhibition. — Defective O'Connor, stationed at Ohristehurch, said that he saw the accused Solomon on June 21st in Lyttelton Gaol. Ha aßkcd acouaed if he knew anything about the watch which M'Kenzie sold to Jenkins in Dunedin, and he said he did not. He afterwards said that ha went with M'Kenzie to the Octagon to Bell the watch to Jenkins, and the latter bought the watch for 30s. Aooused further said that a few days afterwards he asked Jenkins to lend him a pound, which Jenkins did.—After hearing argument by counsel, their Worships considered that they could not convict Solomon under the information laid. The oase against him would be dismissed. M'Kenzie would be oonvicted, and sentenced to threß monfchß' imprisonment, with hard labour.—Mr Hanlon,requested that M'Kenzie might be placed under the Probation Act' as a flrat offender.—The Benoh refuted the application. (Before Mr B. Wilson, J.P.) Ann Smith, alias Sherry, was charged on remand with keeping a disorderly house. There was no appearance of accused.—The police Intimated that) accused had now left the house.—She was therefore discharged. ■ . '
