E. Eliott, Fagan, Guthrie, Mvmroj Murray, Robin, Scoullar, Street. THE BECENT ELECTION OP COUNOIIXOB". . The Town Clerk' announced the return-of Messrs Dick, Street, Robin, and Guthrie, as councillors for Loitb, High, Bell, and South Wardß respectively. The MaTOK said that, notwithstanding tho comments of the Press, he thought it was a matter of congratulation that the four retiring councillors had been ro-elected without opposition. It was evident that those gentlemen had given such satisfaction to their constituents that no one would oppose them.— (Hear, hear.) • ' • IHB TBAMWAT3. The following letter under date September 14 was read :—" I have the honour to draw your attention to the matter of the. transfer of the tramway concessions from Mr Proudfoot to the City and Suburban Tramways Company, with the view of obtaining the completion of the same on the part of the Council. At their meeting on the 31st ult, the Board of Directors of the Company signed the deed of covenant providing for the renewal or alteration of the steam motors. In doing so the directors acted in perfect good faith, and with the intention that the provisions of the deed should be carried out; and further believing that they thereby gave the City' Council all that wair asked for by them in their letter of 18th May last, and accepted „ by my reply of the 25th May as the basis of agreement in this matter. The requirement of a .money bond, in addition to the.formal deed already agreed to and signed, has naturally Boraewhat of an irritating tendency, and certainly implies a want of confidence in the bona fides of the directors in this matter, which I believe is not intended. In view of all the circumstances of the case, I have every confidence that the Council will now see their way to authorise the signing of the transfer without further delay.—l am, &c, R. A. Lawson, chairman of directors City and Suburban Tramways Company." ' ■.'■.. ' Or Mcnbo thought it was a most extraordinary thing that the gentleman who wrote this letter, on a former occasion wrote to the Tramways Committee asking what the amount of the bond was to be. He moved that the letter be referred' to the Tramways Committee to report. It appeared to him that Mr Lawson was being pulled back by part of his directory. Or Euott wished to correct Cr Munro. Mr Lawson only wrote asking that the draft of the bond should be forwarded to the Company. . Cr Barnes said that surely the Tramways Committee did not wish the Company to put down a "sum of money with this tramway agreement. Cr Carboix pointed out that it was only vi bond to be entered into by two persons for £1500. He seconded Cr Munro's motion. . The Matob said the Council would understand that it "was in the agreement of transfer that the Company must remove or alter the steam motors inside of 12 months from the date of signing." By putting off this matter, councillors would only be putting off the date for the removal of the steam motors.

CrEuorr moved as an amendment —"That a money bond, in addition to the deed executed by the Dunedin City and Suburban Tramways Company, for the removal or alteration of the steam motors within 12 months from the signing of tha deed, be not insisted on as a condition to the Corporation agreeing to the transfer from Mr Proudfoot to the Company." There was sot the slightest doubt that according to the agreement they could get the fulfilment of this bond. When applied to to agree to the transfer from Mr Proudfoot to'the Company, the Council ateo transferred a great deal of the feeling that existed between the Council and Mr Proudfoot. Mr Proudfoot had opposed the Council in every shape and form that he possibly.could, and they could get him to do nothing except by actual force or going to law. In agreeing to transfer to the Company, the Council, in order to make Bure that such opposition should not exist in future, bound dawn the.pew Company by every possible means. But he really did think they should have a little more faith in their fellow men. He was sure that this Company would carry out every article in the agreement as* it stood, and'tho Council should trust to their word and their honour; ■■'.'■

CrßAKNEshad great pleasure in seconding the amendment. He thought.the Company ■would be better to deal with than Mr Proudfoot. The Council should trust to the good faith of the Company. • • Or Munbo was glad to see this matter brought to its present position, because it was what he had always advocated. He was very glad to Bee that some of their 'groat obstructionists had' come round to his way of thinking. He would a3k leave to withdraw his motion. , Leave to withdraw motion refused. Cr Dick thought they should adhere to the original motion. He saw v nb reason why the bond should not be entered into. As far as he could make out from the. correspondence, the Company agreed, to give this bond, and there should be no difficulty about getting a money bond. \The fact that Mr Lawson's directors were irritated was no reason why the Council should give way in this matter. ' Cr Mcbrat said that this proposal about a bond was a lawyer's addition, which did not exist in the original deed." He objected to fresh'matter being introduced, which was only the means of prolonging irritation. He was glad to hear the remarks made by Cr Eliott on this subject, and he agreed that the demanding of this bond implied a want of confidence in the directors.. He believed there would'be no necessity for the bond, and that it would be in the interest of the directors to carry out the agreement, Cr Scoullab did not agree with the remarks of Cr Murray. They had entered into an agreement with this Company; and it should •be carried but. If they eliminated the money bond from the agreement they might as well eliminate, the clause for the removal of the steam motore.. ' Cr Faoan expressed gratification at the turn this tramway question had taken, but he entirely disagreed with CrE.liott's amendment. The proper course was to refer the matter to the Tramways Committee in the ordinary way. ''"•'. , ' •' • ■'.■'' The amendment was agreed to, with the addition that the letter be referred to th*e Tramways Committee, with power to act. , BEPOBTS OF COMMITTEES. The reports of the Water Supply, Gas Supply, and Public Works Committees (already published) were adopted. . finance. The Finance Committee recommended that Mr Kalfe, the newly-appointed clerk to the Licensing Committees or the four districts in the city,,be paid a salary at the rate of £25 per annum. , , .' . TheMAYOB moved the.adoption of the report. As a new Finance Committee was about to be appointed, he wished to make a few remarks in reference, to the Corporation finances. They commenced, the current financial year with a debit balance of a little over £2000 more than it was at the same time the previous year. They commenced the present year somewhat under difficulties, with one or two expensive lawsuits staring them in the face, and it was his' duty to impress on tho several committees the necessity for refraining from expenditure that could possibly be avoided. On the 3rd April 1883 the overdraft was £29,818 upon all accounts, and on the 4th April ISB2 it was,only £27,757. During the current year, however, they had been gradually reducing the overdraft, and at the present moment they had a smaller overdraft than they bad at.the corresponding period last year. The total overdraft at the present moment was £12,193, while on .the 18th September laßt year it was £12,369, so that it was now £156 leas. It was the first time in hiß experience that they had achieved such a satisfactory result; Such was hia belief in the elasticity of their finances that if the Committees refrained for another year, aa they had during the past year, from anything like elaborate expenditure, the chances were, in bis opinion, that the Corporation accounts would assume a much better form than ever they had done. The report was adopted, an amendment proposed by, Cr Gdthbie—".That the salary of the clerk to the Licensing Committees should remain at £40 per annum "—being negatived. APPOINTMENT OF COMHITTEES. The following committees were appointed :— Works —MesßrsFagan, Murray, Barnes, and Carroll. Water—Messrs Eliott, Carroll, Scoullar, I Guthrie, and Barnes. Tho Reserves Committeo rocommended — < " That the Council should take steps to pro- 1 vent the further excavation by Messrs Smith and Fotheringham of their leasehold allotments in the Corporation subdivision of sections 3 nnd 4, block VI, Town district, complained of by Messrs S. do Leon and J. Cafiin, tho adjoining Corporation tenants; as, in the opinion of your Committee, the excavations are not being made to prepare the ground for building on,.as the work of excavatinpr one of the allotments had been going on for the past four years, and no attempt had yet been, made to build thereon. That Mr John Reid (of Messis Iteid and Duncans) ba appointed to value, on behalf of the City Corporation, the land, buildings, and improvements, and to report whether the conditions of lease have been observed in respect of Mr .Win. Goldie's leases of part section 2 and of section 3, block I, Lower Harbour West. That the plans prepared by Mr R. A. Lawson of building proposed to be erected on the Southern Market Reserve be forwarded to his Excellency the Governor for his approval, in terms of ' The Dunedin Southern Market Reserve Leasing Act 18S2' and Amendment Act 1883." The report was adopted. The ordinary meeting of the Council was then closed. THE MASSBI FRAUDS. A special mooting of the Council was held to pass a resolution assuming responsibility on bohalf of tho Dunedin Corporation—under tho provisions of " The Massey Frauds Indemnity Act 1883"—for payment of principal and interest on moneys mentioned in certain debentures and coupons stolen by the late Town Clerk (J. M. Massey). The Council then adjourned.
