Boland and another, Mr Harper; for appellants! contended that as it ivas' decided in the- Supreme Court -in • . the. case-: of O'Mara--w the Fcildmg Borough Goun-!-icil, where the'facts;were.; similar, a building, before exemption could life claimed; must he used"exclusively'' for the purpose of a school, and not carried on exclusively ' for pecuniary gain or profit, .and the fact that persons, not-, scholars, received musical, tuition in the bmldmg, prevented the exemption section'applying. He therefore submitted that the rates were properly levied.. ' ■ Mr- Skerrett, for the respondents, submitted that the, place yvas, a school, and the fact that others .• than ordinary scholars; received musical tuition • not alter its character; -Music was,part of the ordinary curriculum of the, in-, stitutioii;: and was juj. educational :sub-; iect; The- building -was 7 not used for teaching subjects outside the curriculum.
