MAGISTRATE'S COURT, WAIMATE.
(Before T. Hutchison, S.M.) 1 - TUESDAY, sth JULY. ' The information laid by E. C. Studholme against Geo. Lopor, for being ; n possession of protected game, heard on tihd previous Court day, was dismissed, the Magistrate holding that a private individual could not lay an information under the Act. .Geo. Loper was again charged with the same offence, on the information of Jas. Sinclair, Acclimatisation Society's ranger. Evidence was given by E. C. Studholine and Constable Quinn, that on the opening of the shooting season Loper was shooting pukako, and was seen witli two birds in his possession. Mr Middlcton, for the defence, stated that this was an unfortunate case of mistaken identity, and called several witnesses in an endeavor to establish an alibi. The magistrate, in giving judgment, stated that the attempt to prove an alibi aggravated the offence, and fined defendant £5, allowing seven days in which to pay. Mr Perry appeared for tin; prosecution. H. Jackson v. A. Jackson, claim £2O for damage -to a macrocarpa fence. Evidence was heard on the previous Court day. Judgment for defendant, witli costs £3 Bs."
