(Per Press Association.) Diincdin, March 4 M. In November Inst the Commissioner of Taxes sued (i. I-. Dcniiistoii, agent for certain non-resident, traders, for income tax. The amount originally claimed was £«) lis lid, but on .Mr Don nistou refusing lo pay the Commissioner reassessed the amount at €3l !)s :3d. and sued for that amount. The .Magistrate held that defendant was not protected under the Aet, and gave judgment for the Commissioner. The defendant lodged an appeal to the Supreme Court- on a point of law. After further consideration. however, the Crown has decided that the Magistrate's decision cannot he supported, and has intimated that no ell'orf will bo made to collect the tax.
