COMPENSATION
THE KAIWARRA CASE. PROPERTY OWNERS AWARDED £SOO. In tho Supreme Court yesterday, before His Honour Mr Justice' Hosking and the assessors, Mr C. B. Morison, K.C., and Mr L. H. B. Wilson, the hearing of the casq in which John Holmes and Jonah Harris, tanners, trading as Hirst and Co., claimed £B4O from the City Council as compensation for land at Kaiwarra taken for tho purposes of a septic tank, and in respect of the alleged injurious effect to their adjacent land, was concluded. Mr A. Gray, K.C., with Mr 0. NBecro, appeared for the plaintiffs, and Mr J. O’Shea for the City Council. Further evidence was given in support of tho defence.
After duo deliberation judgment was given, in tho afternoon, awarding the plaintiffs £SOO in full compensation. Each party was ordered to pay its own costs, together with its own assessor's fee of £2l. Mr Justice Hosking remarked that-tho award announced was the judgment of the majority. The formal matter would be drawn up and signed later. The court was then adjourned pending the signing of tho award.
