MARRIAGE ANNULLED

AN ILLEGAL CONTRACT. A case in which nullity of a marriage was applied for was heard before His Honour the Chief Justice (Sir Robert Stout) in the Supreme Court yesterday morning. The applicant was Louise Loustaneau Dccleeue, and the respondent William Eastwood, otherwise William Eastwood Honey. The decree was sought on the grounds that the respondent was already married when he went through the form of marriage with the petitioner. Mr T. Young appeared for the petitioner, and the application was not opposed. In evidence it was stated that the parties went through the form of marriage in 1895, and lived together for about three years at Palmerston North. The petitioner, during that time, had no idea that the respondent already had a wife. When she discovered that he was previously married, she left him. It was shown that the respondent was first married on November 21st, 1878, and that he was not divorced by hiss first wife until May 29th, 1899. A decree nisi was granted, to be moved absolute after three months. Costs on the lowest scale were allowed against the respondent.
