AMUSING EVIDENCE IN A CRYS. TAL PALACE VENTURE ACTION,

LONDON, January 27.

■ A remarkable'case arising out of the Anglo-German Exhibition last summer at the Crystal Palace occupied the attention of Mr Justice Pickford yesterday. The Anglo-German Exhibition, Ltd., sued the Phoenix Assurance Company, Ltd., to recover £2OOO on a policy of insurance effected with regard to the takings at the exhibition.. The defendants denied liability, and alleged that they were induced to issue the policy by certain misrepresentations.

Mr Rawlinson, K.C., stated that defendants and five other insurance companies, guaranteed that if the takings of the exhibition did not reach £25,000 they would make up the deficit. The takings fell short of £25,000 by from £IO,OOO to JEII.OOO, and the proportion of the deficit which the defendants were asked to bear was £2OOO. The Phoenix Company alleged that it was wrongly represented to them that the exhibition had the official support.of tho Permanent Exhibition Commission of German Industries, and that the applications for space lettings amounted to about £15,000. It would be flatly denied, said counsel, that any of the alleged misrepresentations were, in fact, made to the defendants. The exhibition had a good ’ measure of support, but ho was ready to admit that in Germany this did not come up to what the plaintiffs had expected. The receipts from the exhibits were not as good as was anticipated. As to space lettings, it. was absurd to suggest that it was ever said to have yielded £15,000 in fact; the total revenue from this source only came to about £IOOO. Mr Christopher Edward Town, secretary of the International Exhibition Committee of the London Chamber of Commerce, said ho was surprised, that the exhibition was not a success. • Counsel; Were there any German exhibits there beyond the sausages at the restaurants of : Lyons and Co.
