Patrician and Derwenter went out before daylight, and there being no spectators it is impossible to say what was done. Later on Pack did a long sweat, while Quibble, SUvermark, and Lady Ellen joined in with him for a short distance, each in succession. Ike and Argonaut did slow work together, and Trapper followed suit alone. Molly Bawn and Garibaldi were treated to two miles at half-speed. 3t. : Clair bad a long sweat With Mokoia for -.a' companion for two miles and St. Swithen for the rest of the journey. St. Ives covered a couple of milea alone. Disowned and Torrent Were scratched for all engagements at the Dunedin Autumn Meeting at 12,45 to-day. DUNEDIN CUP BETTING. - Dunedin, February 9. THE CONVICTION UPHELD, . Christchurch, February 9. In Banco to-day Hr Justice Johnston dismissed the appeal la Porter v. Connor. Porter laid the totolisator odds on the Bio-’ carton course on November 8. He was arrested by Detective O’Connor, convicted at the Christchurch Resident Magistrate’s Court under section 18 of the Gaming and Lotteries Act of unlawfully' conducting a scheme by which prizes of money were competed for by mode of chance, to wit, a horse race. He was fined £25, and appealed. It bad been contended, for the appellant, that the voluntary selection by a person of a horse within appellants’ scheme, depending upon the skill and knowledge of that person, was not a mode of obance. Mr Justice 1 Johnston pointed oat that the totalisator itself is declared by the Both section of the Act to bean instrument of gaming within the meaning of the Act unless used in conformity with the Aot. ' He had no donbt that the appellants’ scheme, which had all the elements of chance which the totalisator had, was a scheme for gaining a prize by a mole of chance, and the license to use the totalisator game could not be invoked' as legalising such a scheme as that referred to. The dividends declared, or in the words of section 18, “competed for by dice or any other mode, of chance,” were not to be confined to modes, ejusdem geneils, with lot or dice. He ; maintained Chief Justice Cockbnrn’s opinion, that there being an element of obance in a transaction of any parties betting by the totalisator on a horserace, such betting might properly bo called a game of chance. The conviction waa confirmed, and costa (10 guineas) were given against Porter. .
