MAGISTRATE'S COURT.

A boy named Charles Perry was chargo 1 at the Magistrate’s Court last week with having discharged a gun in John street. The boy pleaded guilty, and was convicted and discharged. The gun is to remain in the custody of tho police for three years, at the end of which time it will bo handed back to him. A man-n’-warsman named Charles P. Lewis, charged with being drunk and disorderly in the National Hotel, was convicted and discharged. John Neston, for allowing his horse and cart to remain unattended in Willis street for a period longer than was considered necessary, wa3 convicted, and ordered to pay 7s costs. At the Magistrate's Court on Friday Patrick C’Halloran was fined 10s and 7s costs for soliciting employment on tho Wellington and Alanawatu Railway station. O’Halloran was also convictod and discharged on a charge of failing to produce his license when called on to do so by Constable Black. James McCarthy, for having entered tho Masonic Hotel while being a prohibited person, was fined GOs, or in default 10 days’ imprisonment. Peter Oornford was sentenced to three months’imprisonment for failing to provide for his wife and children. Frank O’Neill and Robert Norris, for having stolen two pairs of boots valued at 7s Oil, were sent to gaol for seven days with hard labour. J. Stevenson was ordered to pay .£1 per week for the suppoit of his wife and one child. Lottie King, charged with the theft of a postal order for .£l, the property of Mr Morrison, was committed for trial. Jane Buvego was fined 20s, and costs 15s, on Saturday on a charge of transacting business in view of a publie place in Cook street on Sunday. James Buvege, of Auckland, was charged that, being the landlord of certain premises in Brewers’ Lane, lie was wilfully a party to tho continued use of such premises as a brothel. Mr Nortlieroft fined the defendant .£2O and costs .£.5 3s, or in default of payment two months’ imprisonment with hard labour. The Magistrate commented strongly ou landlords who let houses to prostitutes.

The four men Frank Larkin, (leo. Stewart, Stephen Nixon and < 'has. Jiiggs, who were found on Friday night on the premises of Jacob Joseph, were brought up at the Magistrate’s Court ou Saturday, and convicted and discharged.

In the Magistrate’s Couit la.-t week, before Mr J. C. Marlin, A. 11. Baldwin, dairyman, Cuba street, was charged with having kept hD shop open on Wednesday afternoon in contravention of the Shops and Shop Assistants Act. Hr Findlay appeared for the Labour Department and Mr .lellieoe lor Baldwin. Air Baldwin in his evidence said that when lie took possession of the premises he closed his shop on Mondays and kept, it open on Wednesdays. lie sent in his application to alter the day, and asked if he would he right in closing on Mondays in the meantime, and was informed in the affirmative. lie afterwards received notice from tho department to close on Wednesdays. He ignored the notice, and kept open on Wednesdays, and was summoned for so doing. Mr Jcllieoe contended that the provisions relating to the -ervioe of the notice were directory and not imperative, and as there had been substantial compliance with the provisions the information should he dismissed, it being admitted that the Inspector had not notified Baldwin of tho provisions of the statute within the first I I days of January. Air Martin reserved his decision.
