COUNSEL'S; EXPERIMENTS OBJECTION BY JUDGE [FROM OUR OWN CORRESPONDENT] HAMILTON, Tuei<lasr Th 9 hearing in the Hamilton Supretne Court to-day of a charge of negligent driving causing death was marked by a, sharp exchange between Mr. Justice Blair and the Crown solicitor, Mr; H. T. Gillies. In his final address to the jury, Mr. Gillies said- that he 1 and some constables' had visited the scene of the accident la3t night and had carried out experiments relating to the question of visibility. ' , His Honor interposed and said he would not permit counsel to give his conclusions to the jury. He said ( he strongly objected to counsel giving evidence. Mtf. Gillies submitted that His Honor himself had given evidence regarding an overhead fight and its effect on the Justice Blair replied that what he' had said referred to general principles on the science of optics and not to any particular instance. What he had said was not evidence.
