NEGLIGENCE CHARGE

LORRY DRIVER CONVICTED ACCIDENT SEVEN MONTHS AGO A sequel to an accident involving a cream lorry and a motor-cycle which occurred over seven months ago on the Whakatere-Orere road, in the Clevedon district, was heard in the Papakura Police Court yesterday, when the police proceeded against the driver of the motor-lorry, Archibald McDonald, for negligent driving. Constable T. Holland said McDonald was driving near a bend when the lorry collided with a motor-cycle driven by a young man, Devon Kenalls, who was proceeding to Clevedon, about 8.30 a.m. on March 22. The motorcyclist received a compound fracturo of the right leg and had been in hospital practically ever since. Constable L. E. G. Wilson, of Papakura, said he took a statement from McDonald, who admitted travelling on the wrong side of the road. The magistrate, Mr. W. H. Freeman, pointed out that as the defendant admitted travelling on the wrong side of the road it was useless proceeding. Taking into consideration what might occur later, the defendant would be convicted and ordered to pay Court costs amounting to £1 6s and witnesses' expenses totalling £2 16s.
