THE HUNTER CASE
FURTHER LITIGATION HEARING OF APPEAL [BY TELEGRAPH PRESS ASSOCIATION] WELLINGTON, Friday The hearing of an appeal in the Hunter case began late this afternoon beforti the Court of Appeal, when counsel for the appellants outlined the facts which were placed before the Supreme Court at Wellington between June 17 and August 3 last. The appeal is against the decision of Mr. Justice Smith that Cyril Paul Hunter be removed from his position as executor of the estate of the late Sir George Hunter, and that he and Thomas Percy Hunter be removed from their positions as trustees. The appeal is also against an order as to costs. The original Supreme Court action was brought by Lady Edith May Hunter, and concerned the conduct by Cyril Paul Hunter and Thomas Percy Hunter, of Porangahau slieop station, one of the main assets in the estate of the late Sir George Hunter. Mr. C. H. Weston, K.C., with him Mr. D. 11. Hoggard, is appearing for the appellants, and Mr. J. D. Willis, with him Mr. Jl. L. A. Cresswell, is appearing for the respondent.- On the Bench are the Chief Justice, Sir Michael Myers, and Mr. Justice Blair, Mr. Justice Kennedy, , Mr. Justice Callan and Mr. Justice Northcroft. The hearing, which is expected to be lengthy, was adjourned until Monday.
