HEARING OPENS TO-DAY

MR. JUSTICE CALLAN TO PRESIDE

Tho retrial of Eric Mareo, musician, of Auckland, on a charge of murdering his wife, Thelma Clarice Mareo, on April 15 of last year, will commence before Mr. Justice Callan in the Supreme Court to-day. Mareo was found guilty on February 26 of poisoning his wife, and he was sentenced to death by Mr. Justice Fair. His counsel's application for a new trial was subsequently rejected by the Court of Appeal in Wellington, but on April 22 leave for a new trial was granted by the Executive Council. The previous trial lasted nine days, and 37 witnesses were called for the Crown. No evidence was offered for tho defence, but it is understood that on this occasion evidence from Australia is being called on behalf of the accused. At the first trial, which was conducted by Mr. Justice Fair, the prosecution was in tho hands of Mr. A. H. Johnstone, K.C., with Mr. Hubble. This time the Crown case will be presented by the Crown Prosecutor, Mr. V. 11. Meredith, who has since returned from abroad, and Mr. F. McCarthy. The defence will again be conducted bv Mr. H. F. O'Leary, K.C., of Wellington, and with him Mr. K. C. Aekins and Mr. Trevor Henry.
