"NOT RATEABLE"
TRAM TRACKS AND LINES TRANSPORT BOARD'S VIEW The view that tramway tracks and overhead power lines laid in streets are not rateablo in law was expressed by the Auckland Transport Board in a letter received by the Newmarket Borough Council last night. Tho board stated that a judgment given recently in the Supreme Court dealt with tho question of tho board's liability to pay rates on tracks and lines. % The letter was referred to the Legai and Finance Committee. The judgment referred to was given by Mr. Justice Northcroft last year in a, friendlv suit by the Grey County Council against the Grey ElectricPower Board, His Honor upholding the power board's contention that the headworks of its power generating plant were "machinery" and were therefore entitled to exemption from rating. Although confirmation could not be obtained last night, it appears, on the argument advanced in this case, that the Auckland Transport Board contends that its power lines and tracks are "machinery" for the purpose ot carrying powor to tho working piece," the tramcar. ♦ "**
