EGGS SOLD ON SUNDAY
SHOPKEEPER FINED AN ANOMALOUS POSITION COMMENT BY MAGISTRATE " It is a, matter for legislation and not the Courts, but it does appear almost an absurdity that milk can be sold on Sunday, and yet cream cannot. If a shopkeeper sells eggs, butter or cream, it is an ofience. It is a matter in which the law requires a little amendment, 1 think." These comments were made in the Police Court yesterday by Mr. W. R." McKean, S.M., when a shopkeeper, Cecil Simpson, was charged on summons with trading on a Sunday. Sub-Inspector Fox said at 8..30 a.m. on December 22 a police sergeant saw two persons leave defendant's shop with parcels, which contained eggs. Defendant had been convicted twice previously for Sunday trading.
On defendant's behalf, Mr. Fawcett said his client was under the impression that it was not illegal to sell" dairy produce on Sunday. However, under the law, milk only could be sold, although it was common knowledge that milkmen delivered cream and eggs on Sunday. Mr. Fox: T don't think a prosecution has been broifght in Auckland regarding the sale of cream on Sunday The Grocers' Association has complained that Sunday trading by other shopkeepers has seriously affected their business, and their secretary has given evidence on the matter. " I think defendant might have misunderstood the position," said the magistrate, in imposing a fine of 10s, with costs.
