HIRE OF HORSES
DISPUTE BETWEEN FARMERS [UY TELEGRAPH —OWN CORRESPONDENT] ROTORUA, Friday A dispute between two neighbouring farmers concerning tho payment for assistance in connection with haymaking and harvesting operations on (he property of both parties was heard in tho Rotorua Magistrate's Court yesterday when Thomas A. Turner, a farmer and contractor, of Clayton Road, claimed L!(J 8s from Hugh Forbes Scott Russell for work done by plaintill' haymaking on defendant's farm about December, ]!).'<,'!. Russell, who confessed liability for tho amount, counterclaimed for an amount of £7 10s as hire of two horses which be bad lent to Turner for harvesting work qn plaintiff's farm. After bearing evidence the magistrate, Mr. S. L. Paterson, said that the presumption by law was that if one man allowed another the use of his property it was to be paid for, and also that the payment was to bo on a reasonable basis. No evidence had been forthcoming to assist him in arriving at a ruling rate for (he hire of horses, although it had been stated that this ranged from 5s to 7s (id a day. He would, therefore, assess a fair hire at Gs 6d a day and allow judgment on the counter-claim for £(\ 10s with eosfs £2 2s, and judgment for plaintiff in an amount of £G 8s with costs £1 4s.
