SEQUEL TO COLLISION
TRUCK DRIVER'S NEGLIGENCE [from our own correspondent] TE AWAMUTU, Friday Reserved judgment was given in the Te Awamutu Magistrate's Court this week by Mr. F. H. Lgvien in n case heard last month in which Hodgson's Motors, Limited, claimed damages from J. McCoinas, hide and skin merchant, Frankton, arising out of a collision on the Great South Road near Ohaupo 011 February 2. It was shown that Hodgson's bus, proceeding to Hamilton, stopped to allow a passenger to alight, when McComas' truck, which had been following the bus, crashed into it. The magistrate, in giving judgment for £22, said: "In my opinion the evidence discloses that the defendant driver was too close up to the bus in circumstances that would have indicated undue risk to a reasonably careful driver. The defective foot-brake added a further element of risk to the position in which the defendant driver placed himself, and in which he continued to remain. In such circumstances he must be held to have been negligent."
