SHAREMILKER'S CLAIM
" NO HOPE OF SUCCEEDING " THE PLAINTIFF NON-SUITED [from our own correspondent] HAMILTON, Wednesday A claim for £307 was hoard in the Putaruru Magistrate's Court before Mr. S. L. Faterson, S.M. The plaintiff was W. E. Atkins, share milker, Tapapa (Mr. A. L. Mason), and the defendant was Edward Newman, farmer, Tapapa (Mr. W. H. Adams, Hamilton). Plaintiff, in his statement of claim, said ho entered into a farm partnership contract with defendant and nino months later the partnership was terminated. Ho claimed £l6O damages for alleged breach of the contract, including damages for alleged wrongful ejection, £37 for manure supplied and £IOO for alleged negligence on the part of defendant in respect of the ffurchaso of stock as agent for plaintiff. Whilo plaintiff was being cross-ex-amined. tho magistrate remarked that plaintiff had contradicted himself on material points, and had no hope of succeeding on his claim. Plaintiff was non-suited and ordered to.pay £lB lis fid costs.
