The case arose out of an accident which occurred on Ihe .Main South Road at. Ngaruawahia on August 19. Plainlifi was walking across the road when he was .struck by a lorry owned by defendant and driven hv his brother. Wilfred Herbert, liryham. Plaintiff had his right leg broken and he alleged that an internal trouble was aggravated bv the accident. He claimed £6OO for loss of business, £149 hospital expenses and £1250 general damages. The evidence was heard yesterday.
Alter counsels addresses and tlio summing up by Mr. Justice llerdman this morning, tlio jury retired at 10.45. Iwo hours later the jury, after consulting tlio Judge, visited Ngaruawahia and examined the point, where the accident occurred.
After live hours' deliberation thw jury returned a three-fourths majority verdict for plaintiff. His Honor awarded plaintiff .€75 special damages, £2OO general damages and £4OO for loss of earnings, a. total of £675. Leave was reserved by the defence to move for a new trial or a nonsuit within 14 (lays.
