INTOXICATED DRIVER
FINE OF £lO IMPOSED The cancellation of his driving licence for nine months and a Gno of £lO and costs was the penalty, imposed on William Samuel Russell, aged 40, financial agent, in the Otahuhu Police Court yesterday, when he was convicted of being found intoxicated while in charge of a motor-car. Defendant, denied the charge, but amended his plea to one of guilty after medical evidence had been heard. Dr E. R. Lnngo said lie had examined defendant after arrest and found his judgment was impaired to some extent. Sergeant A E. Howell said that he and a constable had observed defendant como from a hotel in Otahuhu and enter his car. Defendant was totally unfit to drive and was stubborn and argumentative when asked to stop the engine. Mr, Goldstine, for defendant, submitted there were varying degrees of this type of offence and said that defendant had not actually driven the car. Tho magistrate, Mr. F. 11. Lcvien, said it was difficult for the Court to , distinguish between cases. Defendant would have driven the car hnd tho police not been firm.
