SCOPE OF OPERATION. AMENDMENT BILL PROVISIONS. [BV TRLEG R Al'H. —SrF.C I AT, REPORTER. ] WELLINGTON. Friday. An extension of the definition of the term "industrial matters" for the purposes of awards under the Act of 1925 is proposed bv the Industrial Conciliation and Arbitration Amendment Bill, a Government measure, which has recently appeared on the Order Paper and has been read a first time by the House of Representatives It is proposed that "industrial matters" shall include any matter not within the meaning of that ter.ni as defined in section two of the principal Act, if.the following conditions arc complied with:— (a) If the parties to the* dispute fo which (he award is made exprrvssly agree to regard such matter as an industrial matter; (l>) if the award recites that the parties have so agreed, and that jn tho opinion of tho Court the matter is mlevant to the dispute. If the validity of any provisions contained in any award made before the passing of tho bill is afterwards questioned on the ground that such provisions relate to matters that are not industrial matters within the meaning of tho principal Act, the Court may then consider whether or not such matters are relevant to the dispute. Tho decision of the Court in such case shall have the same effect in relation to the validity of the award, or of any of its provisions, as if such decision had been givou before the making of the award, lu any such, case, all the parties to the award sliuil be deemed to have agreed to regard such matters as industrial matters, unless the disagreement of any partv or parties has been recorded bv the Court.
