DISPUTED SALE OF CAR.

JUDGE ORDERS NEW TRIAL. Whether a motor-car had been delivered to an agent or to a purchaser was tho point at issue in an appeal against a decision of Mr. E. 0. Cut-ten, S.M., which came before Mr. Justice Herdman in Hie Supreme Court yesterday. John Burns and Company, Limited, had claimed £213 from F J. Winder as tho balance of the purchaso money alleged to bo duo on a motor-car. Tho magistrate, holding that the car had been delivered under an agency agreement, gavo judgment for tho defendant, Ilis Honor allowed tho appeal against this decision on tlio ground that tho matter was not one of agency but sale and purchase, and ordered a new trialMr. Haigh appeared for the appellant and Mr. Ilogben for tho respondent.
