ACTION AGAINST COMPANY. BUSES DESTROYED BY FIRE. * [r.Y TELEGRAPH.—OWN CORRESPONDENT, j CHRISTCHURCH, Monday. On March 21 last two large buses were destroyed by fire at New Brighton, and in the Supreme Court, to-day, before Mr. Justice Adams, a claim for £3OOO for insurance was made by the Inter-Citv Motor Services, Ltd., against the Yorkshire Insurance Company. The principal and practically the only shareholder in tho plaintiff company was Walter S. Bussell, the pioneer of motor-buses in Canterbury. In the statement of claim plaintiff stated that his two motor service buses were insured with the Yorkshire Company for £1750 each, and on November 10 last a new policy for £ISOO each was taken out with the same company. The chief clerk of the Yorkshire Company informed plaintiff that the company would not .increase the policy but would consent. to further insurance in the Victoria Insurance Company, which gave a policy of £SOO on each bus. The Yorkshire Company was notified. Plaintiff suffered £3OOO loss by the destruction of the buses and claimed that sum. Tho defence alleged that plaintiff failed to pay the premiums when due and that at the time of the fire premiums amountins to £76 lis 6d were unpaid. It was also alleged that there was a mis-state-ment in the proposal form as to tho purchase price of the buses at the time of the proposals, the price being over- j stated, ai)d that while the buses were in- j sured for £ISOO each with the Yorkshire j Company plaintiff took out an extra sum of £SOO on each bus but it was not endorsed on the Yorkshire Company's policy. .After considerable evidence had been heard the case was adjourned until tomorrow.
