RAILWAY PORTER'S CLAIM.

[by telegraph.—own correspondent ] TATHAPE, Wednesday. In the Taihape Magistrate's Court recently, Archibald Edwin Grant, a railway porter, of Waiouru (Mr. It. C. Ongley), claimed from Walter Stevens, farmer, of Karioi (Mr. Waldegrave, Ractihi), £<l9 10s damages, arising from a collision between defendant's motor-car and ono driven by plaintiff. After evidence had been heard the magistrate, Mr. 11. M. Watson, adjourned the case in order that he might visit the scene of tho accident. Legal argument in writing was afterwards submitted by counsel and tho magistrate then intimated that ho would give a written decision. J n tho absenci of the magistrate the judgment was delivered in tho courthouse yesterday by the clerk of the Court, Mr. W. -T. Vernon. In his judgment the magistrate said that after seeing tho road in question ho considered that tho defendant was negligent and that such negligence w;\s tho cause, of the accident. In the magistrate's opinion it had been established that plaintiff was guilty of contributory negligence. The magistrate said ho accepted tho evidence of an expert that tho value of the car was £3O. He allowed £2 for damage done to plaintiff's clothes and therefore gavo judgment for plaintiff for £32, with costs, which amounted to £ls 16s lOd.
