TWO AUCKLAND SOLICITORS

MISAPPROPRIATION OF MONEYS

WELLINGTON. Wednesday

In the Court of Appeal to-day two applications to strike the names of solicitors from, the rolls- wero heard.

The first application referred to tho case of Henry Karo Emanuel, of Auckland.

Mr. 11. F. Yon ITaast, representing the New Zealand Law Society, stated that an affidavit had been filed in which it was asserted that Emanuel had been committed to the Supreme Court for sentence in regard to defalcations amounting to several thousands of pounds " It was clear, said Mr. Von Haast, that Emanuel had failed to keep tho money concerned in his trust account and that he must havo taken the moneys himself. The Court made an order striking Emanuel off the rolls and ordering him to pay tho costs, amounting to £2l. The second case was that of John Charles Woodley, also of Auckland. Mr. Yon Haast, on behalf of the Law Society, said it was clear that Woodley had misappropriated substantial sums of his clients' money amounting in all to £I6OO.

It was equally clear, said Mr. Von Haast, that Woodley's partner, whose name he would refrain from mentioning lest it should prejudice him, knew nothing of tho transactions.which were controlled entirely by Woodley. Indeed, as soon as ho had any hint of irregularities Woodley's partner called in the auditor to go through tho books, and ho also called tho attention of tho Auckland Law Society to the matter. lie was altogether dissociated from the dishonesty of lus former partner. The Court made an order striking Wporlley off the rolls and ordering him to pay £ls 15s costs.
