TRANSFER OF PROPERTY.
DOCUMENTS DECLARED VOID. COMMENTS MADE BY' JUDGE. [BY TELEGRAPH.—PRESS 'AS3OciATXOk.iI NEW PLYMOUTH, Saturday. . An action by the deputy-official' assignee against. Martha Knapton to have -certain documents declared void has been completed after occupying the Supreme' Court', for the,: greater part of the ' week. The grounds for the action were that de- ' lendant's husband, prior to his bank-. ,rup r tcy,' had transferred his*'.assets to his. wife with fraudulent intent.- .■ / r v.; •• Mr. Justice MacGregor held that fraudulent intent had been proved and documents relating to the transfer were declared void. The Judge characterised Knapton's conduct as fraudulent and - his evidence , unreliable and said that the wife had to some extent been a party to.the fraud. ' An order for .the pajrment' of £75 cfcjsts was made against defendant 'in addition,' to all disbursements and expenses. ; The defence was that the property • rfeally' belonged to" the wife in „the first place and that the transfer was liquidation of a lawful; debt.
