COMMENT BY MAGISTRATE. EVIDENCE OF THE POLICE.;, [by,telegraph.—press association.] DUNEDIN. Saturday. An unusual position, the magistrate dismissing a drunkenness charge; occurred yesterday in a case whore defendant alleged that a constable had assaulted him. Mr. Bartholomew, S.M., commented that five, police witnesses swore defendant was drunk, and an equal number of witnesses for the defence swore he was sober. Evidence for the defence was given by some very reliable and reputable Witnesses. Some of the police evidence was very unsatisfactory, and he could not have that confidence in it that he should have.
