CHINESE AWARDED DAMAGES.

ACCIDENT IN MANUKAU ED.

A collision between a motor-car and a Chinese market gardener's cart, on Manukau Road, on the evening of September 18, had its sequel in the Magistrate's Court, before Mr. J. W. Poynton, S.M., yesterday. . Gock Choy (Mr. Tong), market gardener, sued A. L. Rogers (Mr. Hogben), for £12 17s 6d damages alleged to have been suffered through defendant negligently colliding with plaintiff's cart. Defendant counter-claimed for £36 5s damages, (alleging that plaintiff negligently drove his cart along the road without sufficient lights, causing defendant's motorcar to collide with it. Mr. Tong said that plaintiff was driving slowly along the road, within » few feet of the kerbing on his correct side, when suddenly a motor-car, coming from he knew not where, smashed into him and caused the damage complained of. For defendant, who denied negligence, it was contended that the light on plaintiff's cart, which was near the centre of the road on the left-hand side, was not visible, being obscured by & bag that had contained the horse's feed. The magistrate gave judgment for plaintiff for the amount claimed, and also on the counter-claim.
