MOTOR-CYCLE DISPUTE.
VENDOR AND PURCHASER.
An action in regard . to the sale of a motorcycle and side-car . was heard by Mr. F. K. Hunt, S.M., in ' the Magistrate's ■'■ Court ■, yesterday. John '■ James Bailey (Mr. Steadman) sought to recover £40 from George Aubury (Mr. Hogg), being balance alleged to be due in respect of a motor-cycle, which defendant bought from plaintiff under an agreement , dated April 30, 1923. ■ Defendant paid £20 deposit, and agreed to pay the £40 balance by monthly instalments of not less than £5/ Those payments had not been made. Defendant counter-claimed for £40, alleging that the machine did: not com-, ply with the representations; made.'.'/ \ Plaintiff contended that owing to defendant's inexperience the ' machine had not proved satisfactory. » -' _ : Defendant said there were concealed, defects which rendered the cycle unsafe. He had sold it by auction for*' £20. Evidence was given by an; expert to the effect: that ;. the cycle, at -Us' best, was worth: £40. , " * , The: magistrate gave judgment for plaintiff for £20, and costs. By consent the counter-claim was withdrawn.
