DISPUTE OVER A FENCE.
PLAINTIFF NON-SUITED.
The erection of at fence at Manurcwa was the subject of a dispute heard in the Magistrate's Court yesterday before Mr. F. K. Hunt, S.M., when a claim for £40 10s was made by F. J. Ellis (Mr. Vallance) against H. W. Hood (Mr. Northcroft). Counsel for plaintiff said that a notice to fence was given to defendant, and as no objection was made plaintiff called for tenders and the work was done by u*« lowest tenderer. Plaintiff asked that defendant pay half-cost of the fence, v. . For the defence, it was maintained that a letter sent to plaintiff. soon after the receipt of the notice was an intelligent layman's version of a cross-notice. Plaintiff had not proceeded in accordance with the Act, while the cost of the fence was described as extravagant. The existence of a contract was denied by defendant. The magistrate upheld the defendant's claim for a non-suit. It was agreed between the parties that the fence should be removed and a new one erected to mutual satisfaction.
