DISPUTE OVER TENANCY.
CLAIM AND COUNTER-CLAIM.
JUDGMENT FOR DEFENDANT.
An action arising out of an alleged tenancy agreement was heard in the Magistrate's Court yesterday before Mr. E. C. Cutten, S.M. The plaintiff, James Robert Hill (Mr. Newbery), said he agreed with defendant, Margaret Hudson (Mr. Adams), to sub-let to her three rooms at a rental of £2 a week. He claimed the sum of £11 ss, being amount of rent alleged to be due. The defendant counterclaimed for £48 10s, which she alleged she had lent to plaintiff in various suras. The plaintiff said there was no question of a partnership when the tenancy agreement was made. He denieid that the defendant had ever paid his. boat fares to Whangarei or bought, him hats and boots. The defendant maintained that the agreement provided for taking a house at Parnell in her name, the profits to be divided. She had lent plaintiff various sums of money, bub nothing had been returned. The magistrate said that with reference to the claim, defendant's story was obviously the true one and she was entitled to judgment. As far us the counterclaim wag concerned, the defendant was in difficulty, as she was an uneducated woman, and had kept no record of the money she said she had lent. She could not succeed on all her claims, but in three instances, where sums of ill ss, £7 13s, and £12 10s were concerned, she was entitled to succeed. Judgment was for defendant on the counter-claim for £21 8s with costs.
